This Warranty Agreement (the "Agreement") is entered into by and between Swish Latvia, hereinafter referred to as "Swish Tiles," and the purchaser of Swish Tiles products, hereinafter referred to as the "Buyer."

Warranty Coverage
Swish Tiles warrants its products against defects in material and workmanship, subject to the terms and conditions stated herein. The warranty coverage for Swish Tiles products is as follows:

• Elastic Series: 10-year warranty
• Large-Elite Series: 10-year warranty
• Elite Series: 15-year warranty

Warranty Exclusions
This warranty does not cover damages caused by accident, improper installation or disassembly, improper care, negligence, abuse, abnormal wear and tear, or any other cause not arising out of defects in material or workmanship of the components.

Warranty Claims
In the event of any defects caused by Swish Tiles, Swish Tiles will, at its sole discretion, provide free replacement tiles to the Buyer. Swish Tiles may request the return of defective items, and the costs associated with the return will be the responsibility of the Buyer unless the claim is due to a manufacturing defect.

To initiate a warranty claim, the Buyer must contact Swish Tiles via email at info@swishtile.com and provide a detailed description of the defect, including pictures and/or videos as proof. After reviewing the case, Swish Tiles will reach out to the Buyer to provide further instructions.

Limitation of Liability
Swish Tiles' liability under this warranty is limited to the remedies of replacement as described above. Swish Tiles disclaims all other warranties of any kind, expressed or implied, in fact or in law, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

In no event shall Swish Tiles be liable for any direct, special, incidental, or consequential damages resulting from any breach of warranty or under any other legal theory. Swish Tiles' liability is limited to the cost of replacement tiles.

Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Latvia, without regard to its conflict of laws principles. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Latvia.

Severability
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

Entire Agreement
This Agreement constitutes the entire understanding between Swish Tiles and the Buyer regarding the warranty of Swish Tiles products and supersedes all prior discussions, agreements, or understandings, whether written or oral.

Warranty Transferability
This warranty is not transferable to subsequent owners of the Swish Tiles products within the warranty period.

Scope of Coverage
This warranty covers defects in material and workmanship. A defect is defined as any non-conformity that affects the performance or appearance of the Swish Tiles products.

Exclusions and Limitations
This warranty does not cover damages resulting from modifications, improper maintenance, failure to follow installation instructions, normal wear and tear, or damages caused by misuse or abuse of the Swish Tiles products. It is important to note that Swish Tiles is not responsible for any logos or design requirements chosen by the Buyer that may violate copyright issues. The Buyer assumes full responsibility for ensuring compliance with copyright laws when selecting logos or design elements.

Return and Shipping Procedures
If Swish Tiles requests the return of defective items, the Buyer shall be responsible for the costs associated with the return unless the claim is due to a manufacturing defect. Swish Tiles will provide detailed instructions for packaging and returning the defective items.

Dispute Resolution
Any disputes arising from or related to this warranty agreement shall be resolved through arbitration/mediation in accordance with the rules of Swish selected parties. The decision of the arbitrator/mediator shall be final and binding.

Customer Responsibilities
The Buyer is responsible for the proper installation of Swish Tiles products in accordance with the provided instructions. Regular maintenance and compliance with Swish Tiles' guidelines are also the Buyer's responsibility.

Amendment and Termination
Swish Tiles reserves the right to amend or terminate this warranty agreement with reasonable notice to the Buyers. Amendments shall be effective upon their posting on the Swish Tiles website or notification to the Buyers.

Language of the Agreement
This Agreement is written in English. In the event of any discrepancy between translated versions, the original English version shall prevail.

Manufacturer's Rights
Swish Tiles reserves the right to inspect and verify any warranty claims before proceeding with replacements or repairs.

Legal Rights
The rights provided in this warranty agreement may vary from country to country. Buyers are encouraged to consult their local laws regarding warranties to understand their additional rights, if any.

By purchasing Swish Tiles products, the Buyer acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Warranty Agreement.
